Pantalones Tequila Privacy Policy

1. Introduction

This Privacy Policy explains how Hardcrafted LLC and its affiliates, including Alps W&S Opco LLC (together, "Pantalones," "we," "us"), collect, use and share personal information. It covers pantalonestequila.com (the "Site"), our email program, our sweepstakes and promotions, our social media pages, and events where we collect your information (together, the "Services").

For adults 21 and over only. Our Services are intended only for people of legal drinking age, which is 21 in the United States. Please do not use the Services or give us any information if you are under 21.

Purchases are handled by our checkout partner and licensed retailers. When you buy tequila or merchandise through the Site, your order goes through Flaviar Checkout, operated by Flaviar, Inc. Tequila is sold and shipped by an independent licensed retailer, and merchandise is sold by Flaviar. Flaviar, the retailer and their payment processors collect your order and payment information and use it under their own privacy policies, including Flaviar's checkout privacy policy. We do not receive your payment card information. This Privacy Policy covers only the information that Pantalones itself collects or receives, including purchaser information we receive through our online store and from Flaviar (Section 2).

We do not knowingly collect sensitive information such as health data, precise geolocation, or financial account details. The exception is tax information from prize winners where the law requires it.

3. How we use information

We use personal information to run the Services, market our products to adults who want to hear from us, and comply with the law.

  • Provide the Services: operate the Site and store locator, answer your questions, and send information you request.
  • Marketing: send emails and mail about our products, events and offers, where you have agreed or the law otherwise allows. You can opt out at any time (Section 7).
  • Promotions: run sweepstakes, contests and events, verify eligibility, select and notify winners, and deliver prizes, as described in each promotion's official rules.
  • Advertising: show you our ads on other websites and social media, and measure how well they work (Section 5).
  • Analytics and improvement: understand how the Site and our marketing are used, and improve them.
  • Age and legal compliance: confirm that people we market to are 21 or older, follow alcohol advertising rules, and meet our legal, tax and regulatory obligations.
  • Security: prevent fraud, abuse of promotions and security incidents, and protect our rights and the rights of others.
  • Business changes: evaluate or complete a merger, acquisition, financing or sale of assets.

We may also use information in ways we describe when we collect it, or with your consent. We may create de-identified or aggregated data that no longer identifies you, and use it for any lawful purpose.

4. How we disclose information

We do not sell your personal information for money. We disclose it only to the following:

  • Service providers that work for us, such as our landing page builder (Shogun), our email marketing platform (Klaviyo), analytics providers, IT and security vendors, and prize fulfillment companies. They may use the information only to provide services to us.
  • Our affiliates. We share information among Hardcrafted LLC and companies under common ownership or control with it, including Alps W&S Opco LLC, which employs the staff who run our business. They use it only for the purposes described in this Privacy Policy.
  • Shopify. Our online store is hosted by Shopify. Shopify processes your information when you visit and make purchases on the Site, including to provide services based on your interactions with other merchants and with Shopify. Shopify combines this information with data from other Shopify merchants to power features that help merchants protect, grow and improve their businesses, such as personalization, store performance and ad targeting based on your activity with other merchants and with Shopify. Your information will be shared with Shopify and other third parties that may be located in other countries, in order to provide services to you, including services that incorporate data from your interactions with other merchants and with Shopify. See Shopify's Consumer Privacy Policy for how Shopify handles your information. You can also ask Shopify directly to delete your data or to stop sharing it for advertising through the Shopify privacy portal.
  • Flaviar and retailers. Flaviar operates our online store's checkout and manages our paid advertising on Meta and Google, and licensed retailers fulfill orders. Flaviar may access Site, advertising and sales data to provide these services, and uses customer information under its own privacy policy (Section 1).
  • Promotion partners. If you enter a promotion we run with a partner, we share entry information with that partner only as the official rules describe and you agree.
  • Creator and affiliate partners. If you reach the Site through a link from one of our creator or affiliate partners, Shopify Collabs records the referral so we can credit and pay that partner.
  • Advertising and analytics partners. Meta (Facebook and Instagram), Google (including YouTube) and InMarket collect information through cookies and pixels on the Site. Our website platform also sends some information directly to Meta and Google from its servers (Section 5). Some state laws may treat this, and information collected through our landing page builder (Shogun) and Shopify Collabs, as a "sale" or "sharing" of personal information or as "targeted advertising." You can opt out (Section 7). We or Flaviar may also upload customer email addresses in hashed form to Meta or Google to show our ads to existing customers or to similar audiences.
  • Legal and safety. We disclose information when we believe it is required by law, a court order or legal process, or needed to protect the rights, safety or property of Pantalones, our customers or others.
  • Business transfers. Information may be transferred as part of a merger, acquisition, financing or sale of assets, under this Privacy Policy.
  • With your consent, or at your direction.

5. Cookies, analytics and advertising

We and our partners use cookies, pixels and similar tools on the Site to run it, understand how it is used, connect your visits to our emails, credit our creator partners, and show you relevant ads.

Let these partners show you our ads on other sites and apps and measure the results. These partners may collect information about your online activity over time and across different websites.

Server-to-server sharing. Some information about your activity on the Site is sent directly from our website platform's servers to Meta, Google and Klaviyo, rather than only through your browser. This may include identifiers such as your email address or phone number, which advertising partners typically receive in hashed (scrambled) form, so these partners can match the activity to their users. Blocking cookies in your browser may not stop this sharing on its own. To turn it off, use the choices below.

Your choices.

  • Use the Your Privacy Choices link in the Site footer or visit {{data_sharing_opt_out_page_url}} to opt out of the sale or sharing of your personal information and targeted advertising. This stops the Meta, Shogun and Shopify Collabs tools on the Site, including their server-to-server sharing, and Shopify's use of your activity for cross-merchant advertising. Google's tools and our email platform (Klaviyo) continue to run after you opt out, because those providers have classified their data use as not a sale. You can limit Google's ad personalization using the Google links below. An opt-out through this link may apply only to the browser and device you use, so you may need to opt out again on each browser or device, or after clearing your cookies. GPC applies in each browser where it is turned on. You will still see ads after opting out, but they may be less tailored to you.
  • Set your browser to block or delete cookies. Some parts of the Site may not work without them.
  • Opt out of Google Analytics at tools.google.com/dlpage/gaoptout, and manage Google ad personalization at myadcenter.google.com.
  • Opt out of interest-based ads from many companies at optout.aboutads.info and optout.networkadvertising.org, and adjust your ad settings in your Meta account.

Do Not Track and Global Privacy Control. The Site does not respond to browser "Do Not Track" signals. We treat a Global Privacy Control (GPC) signal from your browser the same way as an opt-out through the Your Privacy Choices link.

6. Marketing emails

We send marketing emails only to adults 21 and over who have signed up or otherwise agreed to receive them.

  • Unsubscribing. Every marketing email includes an unsubscribe link. We will still send messages about promotions you entered or requests you made.
  • Purchases through Flaviar Checkout. If you buy Pantalones through Flaviar Checkout, Flaviar shares your name, contact details and order information with us, including whether you chose to subscribe to our emails. We send marketing emails only to purchasers who subscribed, and you can unsubscribe at any time.
  • Partner promotions. If you agreed, when entering a promotion run by one of our partners, to receive emails from us, the partner shares your contact details with us and we may send you marketing emails. You can unsubscribe at any time.
  • No marketing texts or calls. We do not send marketing text messages or make marketing calls. If you give us your phone number, for example when entering a promotion, we use it only to run that promotion or respond to your request.

7. Your choices and privacy rights

You can opt out of our marketing at any time. Depending on where you live, you may also have the legal rights described below.

Choices available to everyone

  • Unsubscribe from emails using the link in any marketing email.
  • Opt out of targeted advertising using the Your Privacy Choices link ({{data_sharing_opt_out_page_url}}), and manage cookies in your browser settings (Section 5).
  • Ask us to update or delete your information by contacting us (Section 8).
  • Withdraw your consent to a promotion partner sharing your information with us, or to our use of information a partner shared, by contacting us (Section 8). We will stop using that information for marketing and let the partner know where our agreement with them requires it.

State privacy rights. Depending on where you live, state privacy laws may give you the rights below. We honor these requests from all U.S. residents, subject to verification and the exceptions the law allows. You have the right to:

  • Know and access the personal information we hold about you, and get a copy in a portable format;
  • Correct inaccurate personal information;
  • Delete personal information;
  • Opt out of the sale or sharing of personal information, targeted advertising, and profiling that has legal or similarly significant effects;
  • Not be discriminated against for exercising these rights.

We do not use or disclose sensitive personal information for any purpose that would require us to offer a right to limit it.

How to make a request. Email howdy@pantalonestequila.com. To opt out of targeted advertising or the sale or sharing of personal information, use the Your Privacy Choices link in the Site footer ({{data_sharing_opt_out_page_url}}), email us at howdy@pantalonestequila.com with "Opt out" in the subject line, or turn on Global Privacy Control in your browser. We will verify your identity by matching information you give us with what we hold. We may decline requests we cannot verify, or where an exception in the law applies.

Authorized agents. You may use an authorized agent to make a request for you. We may ask the agent for proof that you authorized it, and ask you to confirm your identity directly.

Appeals. If we deny your request, you may appeal by replying to our decision or emailing howdy@pantalonestequila.com with "Appeal" in the subject line. We will respond within the time the law requires. If you disagree with our decision on your appeal, you may contact your state attorney general.

California "Shine the Light." We do not disclose personal information to third parties for their own direct marketing purposes. California residents may ask for information about any such disclosures by contacting us.

Nevada. We do not sell covered information as Nevada law defines it. Nevada residents may send an opt-out request to howdy@pantalonestequila.com.

8. Other important information

Security. We use reasonable administrative, technical and physical safeguards to protect personal information. Examples are access controls, multi-factor authentication and encryption. No method of transmission or storage is completely secure.

Retention. We keep personal information only as long as needed for the purposes in this Privacy Policy, or as the law requires. We keep marketing contact information until you unsubscribe or ask us to delete it, or until we determine it is no longer useful for our marketing. We keep a record of unsubscribe requests so we can continue to honor them. We keep promotion records as long as required by the official rules, tax rules and other legal requirements.

Age limit. The Services are not intended for anyone under 21. We do not knowingly collect personal information from anyone under 21. If we learn that we have, we will delete it.

Other websites. The Site links to websites and services we do not control, such as Flaviar Checkout (see Flaviar's checkout privacy policy), retailers and social media platforms. Their own privacy policies govern how they handle your information.

Location of processing. The Services are intended for U.S. residents. We and our service providers, including Shopify, may process and store information in the United States and other countries.

Changes. We may update this Privacy Policy from time to time. We will post the new version here with a new "Last updated" date. If the changes are material, we will give additional notice, such as a banner on the Site or an email.
